Terms of Service
1 · Who's party to this
"Kinetiq" means Aspen Unity Capital LLC, a Delaware limited liability company. "You" means the individual or business using or evaluating the Kinetiq service. By using this website or submitting any form you agree these terms govern that interaction.
2 · What the service is
Kinetiq provides, in various combinations: an AI-powered phone receptionist, workflow automation between your existing tools, conversion-oriented landing pages, and managed paid-traffic campaigns. Exact scope is defined in your individual contract.
3 · Pilots and the refund guarantee
We run 30-day pilots on Starter and Growth plans. If we fail to ship a working receptionist within three weeks of your signed kickoff, we refund that month's fee in full. "Working" means: answers inbound calls, reads your business information correctly, books appointments in your calendar system, and routes urgent calls. The three-week clock starts the business day you complete onboarding.
4 · Pricing and billing
Plans are billed monthly or annually in advance. Prices are listed on the pricing page at the time of contract. Annual billing saves 15%. Additional ad spend, if we're managing paid traffic for you, is billed as a direct pass-through (no markup, receipts available on request) and is separate from the management fee. We do not take any percentage of your ad budget. Taxes are added where applicable.
5 · Cancellation and pause
Month-to-month: cancel with 30 days' notice and you pay only through the notice period. Annual: cancel any time; if you cancel mid-term we refund the unused months minus the discount you received. Seasonal pause: up to 90 days per calendar year at no cost; just email us.
6 · Your data, your ownership
You own your business data, your customer conversations, your ad accounts, and any material you create with us. We hold it to run the service. If you leave, we export everything we hold in a reasonable format on request and delete our copies within 30 days.
7 · Acceptable use
Don't use Kinetiq for unsolicited calls, spam, debt-collection harassment, fraud, or anything a reasonable person would consider illegal in your jurisdiction. We reserve the right to terminate service and refund any unused balance if we find the service being used for these purposes.
8 · Service level
We target 99.9% uptime on the receptionist and core automations. If a disruption is on our side and you miss calls because of it, we credit the affected day's fee on the next invoice. Scale clients get a written SLA with specifics.
9 · Liability
To the extent permitted by law, Kinetiq's total liability under these terms is capped at the fees you've paid us in the twelve months before the event giving rise to the claim. We're a small team — if something goes wrong, we'd rather fix it and make you whole than fight about it, but this cap protects us from catastrophic exposure disproportionate to what you pay. This does not limit liability for gross negligence, fraud, or intentional misconduct.
10 · Changes
If we need to change these terms materially, we email every active client at least 30 days in advance and post the change on this page with a new date. If you don't like the change, you can cancel with no penalty during that 30-day window.
11 · Governing law
These terms are governed by the laws of the State of California, USA. Kinetiq accepts clients globally where local law and our infrastructure permit. For clients located outside the United States, Canada, the United Kingdom, or the European Economic Area, additional jurisdiction-specific terms will be negotiated as part of your individual contract. Final venue is set in each client's signed contract.
